Terms of Service

Last updated: 9 September 2026

These terms govern your use of Email.biz.pk. By creating an account you agree to them. If you are agreeing on behalf of a company, you confirm you have the authority to bind that company.

1. The service

Email.biz.pk is bulk email marketing software. We relay your campaigns through sending accounts that you connect and control — Google Workspace, Microsoft 365, or a custom SMTP host — distributing volume across those accounts to keep each one within safe sending limits.

We provide the sending infrastructure, scheduling, validation, tracking and compliance tooling. We do not provide the mailboxes, the domains, or the contact lists. Those remain your responsibility.

2. Acceptable use

This is the most important section of these terms, and the one most likely to result in account termination if ignored.

You may only send to recipients who have given you permission to contact them. Specifically, you must not use the platform to:

  • Send to purchased, rented, scraped or otherwise harvested address lists.
  • Send messages that misrepresent the sender, the sending domain, or the subject matter.
  • Send content that is unlawful, fraudulent, defamatory, or that infringes someone else's rights.
  • Send phishing messages, malware, or anything designed to deceive a recipient into disclosing credentials or making a payment.
  • Circumvent, or attempt to circumvent, an unsubscribe request or a suppression list entry.
  • Send adult content, or promote gambling, illegal substances, or weapons.
  • Use the platform to test, probe or attack the security of any system.

We monitor bounce and complaint rates. Accounts generating abnormal rates may be suspended pending investigation, because sustained abuse damages deliverability for every sender on the platform.

3. Compliance obligations

You are responsible for complying with the law that applies to your sending, including CAN-SPAM, GDPR, PECR, CASL and any local equivalent. In practice that means, at minimum:

  • A lawful basis, usually consent, for contacting each recipient.
  • Accurate sender identification and a subject line that reflects the content.
  • A valid physical postal address in every commercial message.
  • A working unsubscribe mechanism, honoured promptly.

We add an RFC 8058 one-click unsubscribe header to every campaign and maintain your suppression list automatically. That helps you comply — it does not transfer the legal obligation to us.

4. Your account

You are responsible for the security of your credentials and for all activity under your account. Notify us immediately if you believe your account has been compromised. You must be at least 18 years old to hold an account.

5. Plans, limits and billing

  • Subscriptions are billed monthly in advance, in USD or PKR, through Stripe.
  • Each plan defines limits on sending domains, sending accounts per domain, and concurrent active campaigns. These are enforced in the application; you will be prompted to upgrade rather than charged automatically for exceeding them.
  • You may upgrade, downgrade or cancel at any time through the billing portal. Changes take effect from the next billing cycle.
  • Cancelling stops future charges. You keep access until the end of the period you have already paid for. We do not provide pro-rata refunds for partial months except where required by law.
  • If a payment fails, we will retry and notify you. Sustained non-payment results in suspension and eventually account closure.

6. Deliverability

We will not promise inbox placement, and you should be sceptical of any provider that does. Whether a message reaches the inbox is decided by the receiving mailbox provider, based on factors including your domain reputation, your content, and how recipients engage with it — none of which are wholly within our control.

What we commit to is the technical work that makes good placement possible: authenticated sending, volume distribution, randomised timing, automatic cool-down on provider errors, and accurate suppression handling.

7. Availability

We aim for high availability but do not guarantee uninterrupted service on standard plans. Planned maintenance will be announced in advance where practical. Enterprise agreements may include a specific uptime SLA with defined remedies; where such an agreement exists, it takes precedence over this section.

8. Your content

You retain all rights to your campaign content, templates and contact lists. You grant us only the limited licence needed to store, process and transmit that content in order to operate the service for you.

9. Suspension and termination

We may suspend or terminate an account that breaches section 2 or section 3, that is used to harm the platform or other users, or that is persistently in arrears. Where circumstances allow, we will warn you first. For serious abuse — phishing, malware, or sending to harvested lists — suspension may be immediate and without notice.

You may close your account at any time. On closure, your lists, campaigns and analytics are deleted in line with our Privacy Policy. Suppression hashes are retained, because discarding them would risk re-contacting people who have opted out.

10. Liability

The service is provided on an "as is" basis. To the maximum extent permitted by law, we exclude implied warranties, and our total liability in any 12-month period is limited to the fees you paid us in that period. We are not liable for indirect or consequential loss, including lost profits, lost business, or loss of goodwill arising from deliverability outcomes.

Nothing in these terms limits liability that cannot lawfully be limited.

11. Changes to these terms

We may update these terms. Material changes will be notified to account holders by email at least 14 days before they take effect. Continuing to use the service after that date constitutes acceptance.
